Liability

To the full extent permitted by law neither Geraldine Rae Ltd nor any associated company, shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whatever on the part of Geraldine Rae Ltd or any of its agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving) costs, expenses or other claims for compensation, whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

All goods supplied by Geraldine Rae Ltd are supplied on the condition that our liability for any fault or defect in the quality, condition, description or fitness for any purpose is a sum not exceeding the purchase price of the particular goods. It is the customer’s or agent’s responsibility to check that they have received the correct design and colour before forwarding to any third party for further processing. Once forwarded to any third party no liability can be accepted for errors which may occur. That condition supersedes any conflicting term submitted to us and any other liability, statutory or otherwise, is excluded.  

Data Protection and Privacy

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons.  First to process your order and second to provide you with the best possible service.  We will not pass your e-mail address to other trusted traders unless you agree. The type of information we will collect about you includes your name, address, telephone number and e-mail address.  We will not retain credit or debit card details.  We will never collect sensitive information about you without your explicit consent.

The information we hold will be accurate and up to date. The personal information which we hold will be held securely.  You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. If you have any questions/comments about privacy, you should also email us.

Orders

Most customers work directly with designers to select and buy our fabrics and wallpapers. Please be aware that there is a minimum order of 2 metres on all of our products.

Products and sampling

We take great care to ensure that the description and specification of our products are correct at time of preparation of this website. However, specifications and descriptions of products on this website are not intended to be binding and are intended to give a general description only of the products. Furthermore and without prejudice to the generality of the foregoing, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.

Please note that our extra wide wallpapers are made from natural materials and are mostly hand printed and so could contain some small blemishes. Such isolated marks can be cut round without excessive wastage. Please carefully follow the hanging instructions supplied with each order.  

Please also note that all natural fabrics can shrink to some extent when cleaned. Please follow any instructions when cleaning.  We would, however, strongly recommend that all our products are dry-cleaned only. Also, although our products have considerable resistance to fading in light, all fabrics do fade eventually. In particular silk has low light fading characteristics and no claims will be accepted for fading. Lightproof linings and interlinings should be used when making silk curtains or blinds. 

Fibres are mostly 100% natural and any speckling and shade change is an inherent quality of the fabric. Colours may vary accordingly.  Given the hand printed nature of these products there may be some slight imperfections; these are inherent and desirable qualities of the process. It is also a characteristic of natural textiles that there will be variations in the weave, colour and texture, including occasional slubs. To ensure exact colour matching all quantities required for future use should be ordered at one time.

You should be aware that natural fabrics such as linen, linen union and silk can easily crease and need to be handled with care during the making process. This is fully rewarded by the beautiful, rich nature and texture of natural fabrics.

Most of our printing is by hand (with the exception of digitally printed striped wallpaper) and therefore colours may not always be exact.  It is in the nature of hand printing and the hand crafted nature of our other products and, in particular embroidery, that there may be small variations and imperfections in finish. These should be regarded as an inherent part of craft based production and a traditional and authentic characteristic of the process. As such claims for such irregularities will not be accepted under any circumstances.

Please be aware that there is a charge of £2 per sample for samples supplied.

Please be aware that the gold metallic could lift if used for anything other than light upholstery, drapes and general soft furnishings.

Martindale test results are available upon request.

Custom colours

All patterns and designs can be custom coloured to your specification. However there will be an additional cost, minimum order requirement and an extended lead time for custom work, which should be discussed and agreed at time of order.

Deliveries

We aim to dispatch stocked items within two working days of order and payment clearance. Products not in stock or made to order may require a lead time of four weeks and over. Delivery times will vary and Geraldine Rae Ltd will give estimated dates of delivery prior to the order being placed.

The full delivery address must be given when the order is placed. We cannot guarantee quoted delivery times and all delivery times are estimates. We are not liable for the consequences of any delay. It is the buyer’s responsibility to be available at time of delivery. Orders should be checked on receipt. It is the buyer’s responsibility to check for any damage to products or packaging and report any damage to Geraldine Rae Ltd and the delivery company within 48 hours. Please do not accept any damaged items or sign the delivery sheet and ask for a damaged freight report which you will sign. Goods are not covered by transit insurance once you have accepted delivery. It is the responsibility of the buyer to ensure that the correct product has been delivered to any other third party for instance curtain makers or upholsterers.

All orders on roll are sent via courier and will be delivered between 09.30 and 5.30 week days only and will require a signature. Orders cannot be sent to a PO Box or multiple address. Orders under 5 metres may be folded and sent via royal mail unless otherwise requested.

Delivery Costs

For a UK mainland address postage is £9.95 + VAT.  Where delivery is to the remainder of the UK, Europe and the rest of the world postage is calculated from the weight of the goods. Please ask for a delivery cost quote. Postage and packaging of samples to The UK and Europe is free of charge. Postage is £5 for each batch of 6 samples to the rest of the world.

Please note that there may be local duties and taxes payable on goods sent out of the UK and that Geraldine Rae Ltd is not responsible for paying these charges which should be paid locally by the purchaser. Geraldine Rae Ltd are not responsible for any delay in clearing customs.

Where delivery is to the remainder of the UK, Europe and the rest of the world postage is calculated from the weight of the goods. Please ask for a delivery cost quote.  Postage and packaging costs of samples to be provided on request.

Claims, Cancellations and Returns

In the event of none receipt of goods any claim must be made in writing within a maximum of 14 days from the date of the confirmed delivery date. In the event of errors or omissions buyers should carefully check all deliveries immediately upon delivery for shortages, faults, damages or incorrectly supplied products and must inform Geraldine Rae Ltd, in writing, within 7 days of the date of delivery.

No claim will be considered under any circumstances should the goods have been cut, modified, hung or damaged by the buyer.

Occasional human error results in samples being wrongly labelled or mistakes made in the supply of fabrics, wallpapers and other products, but it is the customer’s responsibility to check that the correct product has been supplied before further processing.

No returns will be accepted except by prior arrangement. Unauthorised returns will not be credited to the customer’s account. Any returns will only be accepted where products are found to be faulty or damaged on receipt of products.

All products must be returned complete, in perfect condition, unused, unwashed and with the original packaging and you have taken reasonable care to ensure that any item is returned to us safely and not damaged in transit.  Post and package costs are non-refundable and we are not held responsible for returns that do not reach us. We strongly recommend that you return goods to us through a Signed for Service and retain proof of purchase. Please make sure that all items are repackaged in our packaging or in such a way to avoid damage.

We will not be held responsible for any errors in calculating quantities. It is the responsibility of the customer to check all details, including fabric repeats and drops. We will not be held responsible for any fading of fabrics or wallpapers if they have been exposed to gas, carbon monoxide, sun or strong lights or if they have been treated with for example, flame retarding chemicals or softeners, after leaving us.

No claims for labour charges will be accepted under any circumstances.

Please contact us for information on posting returns. Customers are required to pay for the carriage of any goods being returned unless the goods were either faulty or the order was sent out in error, in which case we will refund the postage in full.

Conditions of Sale and Order Confirmation

All orders for goods are accepted when you receive a confirmation e-mail to this effect. We are legally advised to send you this e-mail which you may wish to save for future reference. The confirmation e-mail will include details of your order including your chosen delivery address. Please read our privacy policy regarding our data handling policy. Please note that by placing an order via this website you are making a commitment to Geraldine Rae Ltd to purchase the goods detailed in your order upon the terms described in your order.

Price and Payment

Please note that where prices are shown on the website, these are retail prices and subject to change. Trade customers should contact Geraldine Rae direct to discuss trade prices and trade arrangements.

Payment in full for all retail orders is required before goods are cut, printed or made and dispatched.

Pro forma invoices must be fully paid by trade customers before goods are cut, printed or made and dispatched.

Once full payment is received and items dispatched and received they become the property of the buyer.

Your credit/debit card we will be authorised when your order is placed and processed but you will not be charged for the value of the goods until they are dispatched. This does not affect your statutory rights. A delivery charge will be added to your order were appropriate.

All prices are quoted in pounds sterling (£) and, where sold directly to retail customers, are inclusive of UK charges for VAT. All goods are subject to availability and may be withdrawn at any time. We try to ensure that any price quoted or displayed on the website is the price on the day of your order.

We reserve the right to change any price after you place your order but should we do so, we will inform you before we process your order and you will have the opportunity to cancel your order. The correct price will always appear on the confirmation e-mail when we have processed your order. Where goods are discontinued, or otherwise cannot be delivered, we will inform you by e-mail or telephone and, if possible, suggest an alternative. Where this is part of a larger order we will process and dispatch the remainder of the goods to you in the normal manner. All payments are in pounds sterling.  We accept payment by credit card, debit card and through PayPal.com.

If your order is being dispatched to a destination outside the European Union then your sales tax will be zero. If your order is being sent to an address within a member state of the European Union then the selling price will include VAT at the current rate. Any customs or import duties levied once the delivery reaches your destination country, will be your responsibility.

Dispute

In the first instance any complaint should be made directly to Geraldine Rae Ltd at our contact address and we will endeavour to resolve the issue fairly, confidentially, and effectively within 28 days. This does not affect your statutory rights.
